By using BloomsEye (this website, the Studio at studio.bloomseye.com, and the BloomsEye mobile app), you agree to these terms. BloomsEye is operated by an independent developer (referred to here as "we", "us", or "the operator").

Using the service

BloomsEye provides reference information about garden plants and tools to design gardens. Plant information (bloom times, sizes, hardiness, and care) is offered without warranty of any kind: real results vary with climate, soil, weather, and care. Notes about a plant's toxicity or safety are general information from the sources cited, not medical or veterinary advice; if a person or a pet may have eaten part of a plant, contact a poison control center or a veterinarian. The library's entries were written with AI assistance. A growing share of them have since been checked against named botanical sources by an automated verification pipeline in which AI research agents read those sources and record each claim beside the one it came from; no person reads every entry. The verification page states what each standard checks, and each plant's page states which standard checked it and marks each fact as checked, a house reading, or not yet checked. Illustrated plant cards are generated with AI, labeled as illustrations on each plant's page and named as such in the footer of every page. The community library entries were generated by an earlier AI feature; each one's page says whether it has since been checked. Always confirm a plant's suitability, and its safety for people and pets, before planting.

Your account and content

Garden designs and lists you create belong to you. You are responsible for your account, for keeping its password safe, and for the content you create. You must be at least 13 years old to create an account. You can permanently delete your account, and everything saved under it, at any time from inside the app or the Studio.

Community posts. If you post a garden to ONLINE, it stays yours, and you give us a worldwide, royalty-free license to show it, and to let other members view and copy it into their own gardens, for as long as it is posted. Post only what you have the right to share, use a display name that is not someone else's, and do not include other people's personal information, links, or advertising. Every post is reviewed before it appears, and we may hide or remove any post at our discretion, including after it has been copied. Copies made by other members before a post is removed remain in their gardens. You can update or remove your posts at any time from My Gardens. Posts are shared by gardeners as they are: a posted garden is not a recommendation from us, and the plant information it carries is that garden's, not the checked library's. To tell us about a post, use the Report control on it.

Premium subscriptions

BloomsEye is free to use. An optional paid tier, Premium, adds the fully identified Bloom Calendar, the complete plant companions list and unlimited plants in a garden. The price and billing period (monthly or yearly) are shown at checkout before you pay. On the web, checkout and card processing are handled by Stripe and subscriptions are managed through RevenueCat; if you ever buy Premium inside the mobile app, that purchase is billed by the app store you bought it through and follows that store's own billing and refund rules.

Automatic renewal. Subscriptions renew automatically at the end of each period (each month for a monthly plan, each year for a yearly plan) at the price shown at checkout, charged to the payment method you gave, until you cancel. Before you pay, the checkout states the price, the billing period and that the subscription renews automatically, and completing the checkout is your agreement to those terms. You can cancel at any time: open your plan card on your Profile page (or the Premium page) and choose Manage subscription, which opens your billing portal in the same browser, then choose Cancel subscription; or email support@bloomseye.com from the address on your account and we will cancel it for you. Canceling stops the next renewal, and the paid features keep working until the end of the period you already paid for. If a renewal payment cannot be collected, the subscription ends and the free tier keeps working. If we change a subscription's price, the new price applies only from a later renewal, and we will email you at least 30 days before it does, with how to cancel if you would rather not continue.

Where the law of your region gives you a mandatory cooling-off or withdrawal right, we honor it. Beyond that, payments are non-refundable; if something went wrong with your purchase, write to support@bloomseye.com and we will try to make it right.

BloomsEye Pro

BloomsEye Pro is the professional tier of BloomsEye, for garden designers and landscapers who use it in their work for clients. It includes everything in Premium and adds the Clients tab, the plant list export, and the "Designed by" line on the gardens you share. Pro members may also ask us by email to add plants the library does not carry, up to twenty per subscription: each request is at our discretion, an added plant joins the shared library for every member, and we promise no timeline. To use Pro you must be at least 18 years old and using it for your own business or profession. Pro may be granted by us or bought as a subscription; if you subscribe, the price and billing period (monthly or yearly) are shown at checkout before you pay, and everything in the Premium section above about billing, automatic renewal, canceling and refunds applies to Pro in the same way.

Moving between Premium and Pro. Pro includes Premium, so you never need both. If you already have a Premium subscription bought on the web, you move up to Pro from your plan card or the Premium page (Upgrade to Pro, then Change your plan) rather than by buying a second one: the change takes effect immediately and you pay only the difference, with the unused part of the Premium period you had already paid for credited against the Pro price. If you later change from Pro down to Premium, the change takes effect at the end of the period you have paid for, with no refund, and Premium continues from there. If your Premium was bought through an app store, that store's subscription is separate from your web subscription and we cannot change it for you: cancel it in the store when you move to Pro, so that you are not paying for both.

When Pro ends. When your Pro access ends, for any reason, your gardens and their client labels stay in your account; the Clients tab, the plant list export and the "Designed by" line on your shared gardens stop, and Premium features continue only if you still hold Premium on its own.

Your clients. Pro lets you label a garden with a client's name and hand your client the garden's link and its plant list. Your clients are your clients, not ours: they never get an account with us, and we have no contact with them. You are responsible for what you enter about a client, for having the right to enter it, and for telling your client what you share and how. A garden's name appears on its link and on its plant list, so if a client's identity must stay private, keep it out of the garden's name.

Our content and intellectual property

Everything BloomsEye provides other than your own garden designs and lists is owned by or licensed to the operator and is protected by intellectual property and unfair-competition laws. This includes, without limitation, the website and the Studio and app software; the plant database and the way its entries are selected, checked, and arranged; the plant imagery (including the AI-generated illustrated cards and cut-outs); the written guides and care notes; the overall look and feel; and the BloomsEye name and logo.

The real photographs shown below some plant cards are a separate case: they are contributed by third parties and used under their own CC0 or CC BY licenses, which govern how they may be used and shared. Each photograph shows its credit, and the full list of sources is on the Credits page.

We grant you a limited, personal, non-exclusive, non-transferable, and revocable permission to view and use this content for your own personal, non-commercial gardening. That permission does not transfer any ownership to you. If you hold BloomsEye Pro, the permission extends to your professional work: you may use the plans, plant lists, scaled drawings and exports you make in BloomsEye in your paid work for your clients, and hand them to your clients and contractors. The restrictions in the next paragraph still apply, and the plant information is offered without warranty, so check it against your own professional judgment before it goes into a planting plan.

Except as that permission allows, and without our prior written permission, you may not: copy, scrape, crawl or otherwise harvest in bulk, extract, republish, redistribute, sell, rent, sublicense, or otherwise commercially exploit any part of the content or the plant database; use any of it to build, train, or improve a machine-learning model, an AI system, or a competing dataset; frame, mirror, or systematically reproduce the site; or remove or obscure any copyright, trademark, or other proprietary notice. These restrictions apply to all of our content regardless of whether any individual item is separately copyrightable, and they are a condition of your permission to use the service.

If you send us feedback or suggestions, we may use them to improve BloomsEye without any obligation to you.

Acceptable use

Do not misuse the service: do not attempt to disrupt, probe, overload, or gain unauthorized access to it or its systems; do not use it to break the law; do not scrape or bulk-download its content or database (see the section above); and do not abuse the AI features. We may suspend or terminate access that does, and we may correct or remove community plant entries that are inaccurate or abusive.

Accessibility

We build BloomsEye to be usable by keyboard and by screen readers, we respect your system's reduced-motion setting, and we work toward the WCAG 2.1 AA guidelines across the website, the Studio and the app. If any part of BloomsEye is hard for you to use, email support@bloomseye.com and we will help you get what you came for and fix what we can.

Third-party links and services

BloomsEye may link to third-party websites and services (for example, plant nurseries) and is distributed through the Apple App Store and Google Play. We do not control those third parties and are not responsible for their content, products, or privacy practices; your use of them is governed by their own terms.

The service

BloomsEye is provided "as is" and "as available", without warranties of any kind. To the fullest extent permitted by law, we are not liable for losses arising from planting decisions, plant performance, or interruptions to the service, and we are not liable for any indirect, incidental, or consequential damages. To the fullest extent permitted by law, our total liability for any claim relating to BloomsEye will not exceed the amount you paid us to use it in the twelve months before the claim, which for use of the free tier is zero. Features may change, pause, or be discontinued over time.

Your responsibility for claims

You agree to cover reasonable costs and claims that arise from your misuse of the service or your breach of these terms, to the extent permitted by law.

Governing law and disputes

These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Illinois have exclusive jurisdiction over any dispute relating to BloomsEye or these terms, and you consent to that venue.

Changes to these terms

We may update these terms; continued use after changes means you accept the updated terms. Material changes will be reflected in the date above.
